In a significant judgment, the Rajasthan High Court has ruled that students who did not study Biology in Class 11 cannot be denied admission to MBBS courses if they have studied the required subjects in Class 12. The court directed authorities to grant immediate admission to the affected student.
A division bench stated that eligibility for MBBS admission must be determined solely on the basis of subjects studied in Class 12, not Class 11. The ruling came in response to a petition filed by a student who was denied admission despite qualifying for NEET 2023.
The student had:
Not taken Biology in Class 11
Taken Biology as an additional subject in Class 12
Scored 550 marks in NEET 2023, securing an All-India Rank of 99,439
Achieved 12,449 rank under the EWS quota
Despite fulfilling all NEET requirements, the student was denied admission by the medical college, citing that Biology must be studied from Class 11 onward.
The court noted that:
The National Medical Commission (NMC) Regulations 2023 do not mandate studying Biology in Class 11.
Only Class 12 subjects matter for MBBS eligibility.
Biology taken as an additional subject is fully valid.
The bench emphasized that medical colleges cannot impose conditions beyond what NMC regulations specify.
The High Court instructed the college to:
Admit the student without delay
Ensure compliance with NMC rules rather than internal interpretations
This decision is expected to help many students who take Biology later or as an additional subject but meet eligibility through NEET and Class 12 credentials.
